These Terms of Use ("Terms") are an agreement between you and W859 ("we," "us") governing your use of the Shark Bait mobile application (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What the App is

Shark Bait is a practice timer for wrestling drills. It runs clocks, tracks drill rotations, and plays audio and spoken cues. It is a stopwatch with opinions. It is not athletic instruction, medical advice, or a substitute for qualified coaching and supervision.

2. Assumption of risk

Wrestling and conditioning drills are strenuous physical activities that carry inherent risk of injury. The App only times and sequences drills; you and your athletes remain solely responsible for how drills are conducted. By using the App you acknowledge and agree that:

Participants should be in appropriate physical condition and, where appropriate, cleared by a physician before strenuous exercise.
Drills run with the App must be supervised by a qualified coach or adult, particularly for minors.
You assume all risk arising from athletic activity performed while using the App, and W859 is not responsible for any injury, loss, or damage arising from that activity.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, subject to these Terms and the rules of the app store you downloaded it from. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of the App except where the law expressly permits.

4. Free and Pro features

The App is currently offered free of charge, including features that may later be part of a paid "Coach Pro" upgrade. We may change which features require payment in future versions; features you have already paid for will not be taken away. Any future purchases are one-time in-app purchases processed by Apple or Google under their payment terms, and prices may vary by region. Promotional pricing (including "free for a limited time") may end at any time without notice.

5. Privacy

The App collects no personal data. Anonymous crash reports are the only telemetry. See the Privacy Policy for details.

6. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that timers, alerts, or spoken cues will fire with perfect accuracy on every device.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, W859 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR TEN U.S. DOLLARS IF YOU PAID NOTHING. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

8. Changes to the App and these Terms

We may update, change, or discontinue the App at any time. We may revise these Terms by posting an updated version on this page with a new effective date; continued use of the App after changes take effect constitutes acceptance.

9. Termination

This license ends automatically if you violate these Terms. You can end it at any time by deleting the App.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflict-of-law principles, and any disputes shall be resolved in the state or federal courts located in Kentucky.
